We Won! Now the city has a choice...

The court wrote a 33 page document outlining the case and the decision to side with OSEE. But the city can do a perfunctory job of the analysis that they have been ordered to do and then just override those findings anyway. We need the community to speak out and let them know that you want a thorough analysis of both current conditions as well as proposed potential housing/population, that it should be done by a traffic engineer, with dynamic modeling done by a fire science expert and in collaboration with MOFD. We know we're in the nitty gritty now... You could also just write to the council and tell them that you support OSEE!


Summary of the decision:

“Because the EIR provides ambiguous information on the impacts on evacuation in WFR-1 and does not provide the public and decision-makers with sufficient information to understand the magnitude of the impacts of the Project on evacuation in the face of wildfire hazards, the City did not have sufficient information to balance the benefits of the Project against its adverse impacts, after mitigation, and the City's Statement of Overriding Considerations is therefore not supported.”  See Part VII, page 10, Case N23-0579
